Terms of Service

1.
General Terms

  • Prices are subject to change and are dependent on commision and or demand.
    I expect the price cost I have stated on display.

     

  • I have the right to reject any order for any reason.

2.
payment

  • The currency accepted is USD and can be paid through PayPal, Venmo, or Cashapp.

  • Commissions can be paid either 100% upfront or split 50% upfront and 50% after sketch approval.

  • Don't send me payment before I have agreed to give you a slot and have requested the funds to be sent.

  • BY PAYING, YOU ARE AGREEING TO EVERYTHING IN THE TERMS OF SERVICE AND ACKNOWLEDGE IT.

  • PAYMENTS WILL BE MADE VIA PAYPAL INVOICE, VENMO, OR  CASHAPP

revisions

  • Finish time will currently vary as I am a college student. This could take a moment to complete alongside health concerns, complexity of the commission, etc.

  • Once I have completed the artwork, you will receive the full-resolution image. There is no physical product. Depending on where you live, we can arrange to print your artwork.

  • You will get 3 rounds of alterations on the commission piece included with the price.

  • A fee will be added if you want something altered in the final drawing - unless there is a clear misunderstanding on my end.

  • If you wish for me to alter something in the drawing you have previously approved of, I will charge you a fee to alter it. This extra fee depends on the alteration you want me to make and is based on an hourly wage basis. 

  • If your reference is unclear to start with, alterations will come at an extra cost.

  • I, Waniwin (artist):

  1. Reserve the right to cancel and refund the order at any time for any reason.

  2. Retain all copyrights over the commissioned artwork

  3. Will NOT claim the intellectual property (IP) of the commissioned artwork.

  4. Will NOT profit further from the commissioned artwork unless you (the client) break any of the terms and conditions.

  5. Reserve the right to post the commissioned artwork online, in my portfolio and publications such as art books.

  • You (commissioner/customer/client):

  1. May upload the commissioned artwork on any website and social channels.

  2. May NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, selling prints, etc.)

  3. May NOT alter the commissioned artwork without my (the artist's) consent.

  4. May be allowed to sell the artwork if it is a part of an 'Adoptable.' Please discuss with me prior to paying for the artwork.

  5. Retain the rights to the intellectual property (IP).

  6. May NOT use the commissioned artwork for commercial purposes.

  • The following is considered copyright infringement:

​

  1. Reproducing/using the copyrighted artwork commercially, meaning to make money off it in any way that is not excluded from these terms.

  2. Claiming the artwork as your own.

  3. Altering the artwork without my consent.

Cancellation & Refund

  • The buyer is not allowed to process or request a refund once I start working on the commission.
     

  • If for any reason I am unable to start your commission, you will recieve a full refund.
     

  • If you cancel your order before I have started, you may be eligible for refund.
     

  • If you are receiving a refund, do not request a Paypal chargeback. I will transfer the money back to you.
     

  • If you request a Paypal chargeback at any point when you weren't allowed a refund, you will lose all beforementioned rights to the commission and I'll have full rights to profit from this action taken.
    I will decline the chargeback and supply Paypal with our conversations about the commission as evidence; that I have completed the work for you. Furthermore, you will be blacklisted for commissioning me again.

What do you Get?

  • Drafts/mockups that you decide upon (factoring in complexity of the work involved, there may include more drafting), and we continue on.
     

  • Sketch and/or sketches that you must accept before I continue the work.
     

  • Included insight into color plan (factoring in complexity of the commission).
     

  • Full-resolution file (proper dimensions at 300 DPI) of final drawing and a smaller version for internet upload. Final file formats are usually PNG
